After much hard work and many discussions we have now completed our submission to the Proposed Auckland Unitary Plan.

Scope of Submission

  1. This is a submission to: Proposed Auckland Unitary Plan
  2. The Society requests changes to the following provisions for the reasons set out below:

    (a) General Statement

    For the avoidance of doubt, the Society makes a general submission in support of the provisions of Chapter F 5.23 and Chapter K 5.23, except where otherwise stated in this submission document.

    (b) Chapter F

    It needs to be expressly stated that the Auckland-wide Objectives and Policies will apply in this Chapter unless expressly stated otherwise.

    (c) Chapter F Objectives and Policies 5.23 Long Bay

    The Society supports the Objectives and Policies.

    (d) Chapter F Objectives and Policies 5.23 Long Bay - Introduction

    Add Countryside Living to the list of Zones in the first line.

    (e) Chapter F Precinct Objectives and Policies 5.23 Long Bay - Long Bay Subprecinct H 90

    The Piripiri Point Protection Area (Sub-Precinct H) should be subject to the provisions of Countryside Living, not Large Lot, because it is a single-dwelling site that is not sub-dividable, and that has more in common with the neighbouring Okura zones than with Long Bay.

    (f) Chapter H Auckland Wide Rules - 4.14.3 Stormwater Management Quality

    The Society supports these provisions

    (g) Maps

    To ensure consistency with the Long Bay Structure Plan the following changes are requested to the following Maps.

    Urban Grid 13:Zones

    Change the zoning of the Piripiri Point Protection Area (Sub-Precinct H) from Large Lot Residential to Countryside Living because it is a single dwelling site that is not sub-divisable, having more in common with the neighbouring Okura zones than with Long Bay.

    Urban Grid 13: Built Environment

    The Piripiri Point Protection Area should be included in the additional sub-division controls at a 4 ha net site area.

    Urban Grid 13: Natural Resources

    Amend maps to include the Vegetation -Conservation, Vegetation -Restoration, Landscape Enhancement, and Ecology /Stormwater Management Areas from Long Bay Precinct Plan 4.

    Amend map so that the Significant Ecological Areas align with the Vegetation Conservation, Vegetation -Restoration, Landscape Enhancement, and Ecology/Stormwater Management Areas.

    Amend map to include all land north of Vaughn's Stream and east of ridgeline as Outstanding Natural Landscape as defined by Environment Court Decision for the Long Bay Structure Plan.

    Urban Grid 13 Historic Heritage

    Amend the Historic Heritage Extent of Place as illustrated within the PAUP Maps to include all aspects of the Heritage Management Plan Area Extent as detailed in Appendix 17B/B of the Auckland District Plan - North Shore Section (UNSP").

    Amend the Historic Heritage overlay of the PAUP Maps by removing items 2761 and 2762 identified as sites and places of value to Mana Whenua because archaeological digs have taken place here and all items of value removed.

    Amend the Historic Heritage overlay of the PAUP Maps by limiting extent of places of Value to Mana Whenua for site previously labelled as 1076 to Sub-Precinct G, as archaeological research has shown this to be the extent of the site.

    Urban Grid 13 Natural Resources

    Include the Long Bay Structure Plan area within SMAF 1 or 2 overlay.

    (h) Chapter K Precinct Rules 5.23 Long Bay - 1 Activity Tables Table 1

    Remove reference to Large Lot Residential and replace this with reference to Countryside Living.

    (i) Chapter K Precinct Rules 5.23 Long Bay -1 Activity Tables - Table 2

    Long Bay Area C 1 and 2 should be Area Eland 2 to be consistent with Table 1 7B.7 Long Bay Structure Plan Activities - Long Bay 1 C, 5 and 6 Zones.

    U) Chapter K Precinct Rules 5.23 - 1 Activity Tables - Table 3

    Link all Heritage Management Plan Area Activities to an approved Heritage Management Plan, so that if an activity is not provided for in the Precinct Plan or the Auckland Wide Rules, it becomes a NC activity.

    (k) Chapter K Precinct Rules 5.23 Long Bay - 1 Activity Table 5(b)

    Insert remainder of Table 17B.3 of Auckland District Plan North Shore section relating to Riparian Margins, Landscape Enhancement Area, Ecology/Stormwater Management Area, and Stormwater Management Zones because they have been omitted in transcription of the table.

    (I) Chapter K Precinct Rules 5.23 Long Bay - 1 Activity Table

    Insert Activity Table 1 7B.6 LB SP activities - Long Bay 1 A and 1 B because the zoning of these areas as Large Lot restricts the activities undertaken to exclude currently permitted activities, e.g. pastoral farming.

    (m) Chapter K Precinct Rules 5.23 Long Bay - 3.1 Heritage Management Plan

    Any Heritage Management Plan should be completed by 31 July 2014. This provision should take immediate effect because a Heritage Management Plan is overdue - it was required to be completed by 31 August 2013 and has not yet been done. Any Heritage Management Plan must include 17B.5.1.1 d from the NSP.

    (n) Chapter K Precinct Rules 5.23 Long Bay - 3.2.1 Heritage Covenant

    Transfer of the land should be required by 31 July 2014 because it is now more than two years since the schedule set by the Environment Court required its transfer. The covenant should be provided within in 2 weeks of the transfer of the land to the Council - not 6 months

    (0) Chapter K Precinct Rules 5.23 Long Bay - 4 Development Controls 4.5 Vaughans Road Set Back

    Clarify where the setback is on the Precinct Plan 1 Map because it is not clear. Insert setback on Urban - Map 13 Precinct Plans.

    (p) Chapter K Precinct Rules 5.23 Long Bay - 4 Development Controls 4.7 On-site Stormwater Management

    Part 1 7B.S.8.1.2 Stormwater Mitigation of Impervious Areas of the NSP should be expressly referred to in the Precinct Plan because it will ensure this important issue is not overlooked.

    (q) Chapter K Precinct Rules 5.23 Long Bay - 5.5 Realignment of Stream 1 B

    The Society considers that this Rule is redundant because of the work so far completed at Long Bay.

    (r) Chapter K Precinct Rules 5.23 Long Bay - (t) 4.8.2 b. Fencing in the PIPA

    Remove the word "and" between the words "... the Park Interface Protection Area," and "north and east of the Ridgeline Height Control Line" because it changes the meaning from 17B.5.3.11 b) ii and contradicts 4.8.2 c.

    (s) Chapter K Precinct Rules 5.23 Long Bay - 6.3 Stormwater Management

    Insert Table 17B.4.4.2 of the NSP because this will ensure extra stormwater controls will be considered.

    (t) Chapter K Precinct Rules 5.23 Long Bay - 6.17 Sub Precinct G

    Should say no sub-division in G because all sub-division envisaged by Environment Court will have been done at the time the Unitary Plan becomes fully operative

    (u) Chapter K Precinct Rules 5.23 Long Bay - 8 Restricted Discretionary Criteria

    Expressly incorporate matters from the Auckland Wide Rules relating to cumulative effects, effects on water quality, manu whenua, wildlife and sediment. This should be included in the Precinct Plan because such effects go beyond the catchment itself.

    All general earthworks matters from the Auckland Wide Rules should also be incorporated in to Precinct Plan because the receiving environment is a marine reserve.

    Insert an Introductory Paragraph stating that the stormwater criteria in Part 8 pf 5.23 are "In addition to" the City wide stormwater controls because this will ensure all proper controls are considered.

    (v) Chapter K Precinct Rules 5.23 Long Bay - 8 Assessment Criteria 1

    Insert Table 17B.3.8.3 from NSP because that will ensure consistency with the framework plans.

    (w) Chapter K Precinct Rules 5.23 - 8 Assessment Criteria 3

    Insert criteria from 17B.3.8.2.2 because they are not otherwise sufficiently detailed.

    (x) Chapter K Precinct Rules 5.23 - 8 Assessment Criteria 3

    Insert criteria from 17B.3.8.2.3 because this is the only mechanism in the rules to ensure that the intended outcomes for the Park Interface Protection Area are achieved

    (y) Chapter K Precinct Rules 5.23 Long Bay - 8 Assessment Criteria 3(a)(ii)

    Insert analysis of viewpoints cross sections because that is a critical assessment criteria.

    (z) Chapter K Precinct Rules 5.23 Long Bay - 8 Assessment Criteria 3(a)(iv)

    Insert Table 1 7B 3.8.1 of NSP because this is critical assessment criteria.

    (aa) Chapter K Precinct Rules 5.23 Long Bay - 8 Assessment Criteria 4

    Insert Table 17B.5.8.1 from NSP because the criteria are not sufficiently detailed

    (bb) Chapter K Precinct Rules 5.23 Long Bay -10 Special Information

    The Society considers the requirement for lizard management plans for all earthworks over 300m2 should be reviewed - it may be too onerous.

    (cc) Chapter K 5.58 - Weiti Precinct Plan

    Incorporate the same provisions from Rodney District Plan.

    (dd) Chapter K Precinct Rules 5.23 Long Bay - 10 Special Information

    All applications for subdivision and development must be in accordance with the superior practice guideline titled "Long Bay Development: Erosion and Sediment Control Document".

    (ee) Rural Urban Boundary

    Remove the Long Bay Regional Park, Piripiri Reserve and the Heritage Protection Area from the RUB because this will provide the proper level of protection. Failing thiS, remove the area of the Long Bay Regional Park and Piripiri Reserve north of the Vaughans Stream from the RUB because this is an outstanding natural landscape of coastal and rural aspect.

  3. The Society wants its suggested amendments incorporated into the Auckland Unitary Plan.
  4. The Society wishes to be heard in support of this submission. If others make a similar submission, the Society may consider presenting a joint case with them at a hearing.
